I used to watch this guy named Syndicate when he had a minecraft series waaaay back. Then I started watching some other channels and now I mostly do it out of habit. I'm a sucker for the gaming channels :p

It's... complicated. From what I've read and can decipher, though, Inq is basically correct. (In the United States.)

In general practice, there are two categories, videos up there that violate copyright, and those that don't/aren't or haven't yet been taken down for it. (If a video has a ton of views and has been around for long enough, people often assume that the company that owns that material has turned a blind eye to it, and thus that it's 'okay', even though it's still technically illegal.)

That said... it could be in violation of Youtube's terms of service even if the actual owner of the material doesn't mind. YouTube's policies state that "You should not download any Content unless you see a 'download' or similar link displayed by YouTube on the Service for that Content". In practice, that's basically nothing (I don't recall whether I've ever seen such a link displayed next to anything besides the page showing what it looks like). Violating a company's terms of service is not generally considered as a crime or prosecuted, but it's worth taking into consideration if you have ethical concerns with doing that, and of course, if you were to get sued by the company for it and it came out that you were downloading copyrighted videos in the process, you're sunk. ;)
